A patent should be filed as early as possible!
The filing date of your application is crucial: it is the official starting point for your protection, even if the industrial property rights are not definitively acquired until the patent is granted.
Right of priority
Monaco is a signatory of the Paris Convention. It is therefore possible to claim priority - based on the date - of a first patent application filed in another Contracting State. This right of priority applies on condition that it is claimed within a period of 12 months following the date of the first filing.
To raise a priority claim with the Office, you should send us an official copy of the first filing and indicate it expressly on the application form. If these documents are not in French, they must be accompanied by a translation certified by the translator and the applicant. If you are not the party claiming priority, written permission will be requested from the applicant authorising them to make the claim.
