Monaco aligns with the CP9 Common Practice

The Industrial Property Office of Monaco is updating its procedure for examining the distinctiveness of three-dimensional marks (shape marks) containing verbal and/or figurative elements when the shape is not distinctive in itself, adhering to the common European practice CP9 resulting from the work and legal reflections of the convergence programme organised by the European Intellectual Property Office (EUIPO). The Practice paper for users, examiners of the IP offices and any other interested party can be found  at this link and is also being published on the official EUIPO website here.

As a reminder, Monaco has aligned with the CP3 Common Practice (distinctiveness of a semi-figurative mark including descriptive terms) on 16 September 2021.
